Introduction
Manetti Blanchard S.r.l., Via Maurizio Gonzaga 7, 20123 Milan, VAT number 14317200963, is the owner of the Optilace brand, which markets and distributes through the website manettiblanchard.it (hereinafter the “Website”) cosmetic products of which it is the owner (hereinafter the “Product/Products”) to the users of the Website (hereinafter the “Customer/Customers”).
These general terms and conditions of sale (hereinafter the “General Terms”) govern the purchase of the Products by the Customers, carried out remotely via the Website.
The Customer is required to read and review these General Terms before completing the purchase on the Website. Such information is therefore deemed to have been read, understood, and fully accepted by the Customer at the time of placing the purchase order.
1. Products
1.1 All Products available on the Website are subject to availability at the time of purchase.
1.2 Manetti Blanchard S.r.l. reserves the right to vary, at any time, the limits on the quantities and/or types of Products that can be purchased on the Website.
1.3 The Customer will be informed if the ordered Products are unavailable.
2. Prices
2.1 Prices on the Website are expressed in € (Euros) and relate to each type of Product, excluding shipping costs and any taxes, which will be indicated to the Customer at the time of purchase.
3. Promotions
3.1 Manetti Blanchard S.r.l. reserves the right to offer special sales conditions or promotions on the Products available on its Website.
3.2 The conditions applicable to promotions will be governed from time to time by Manetti Blanchard S.r.l. through specific communications to Customers.
4. Registration
4.1 The Customer may make purchases without registering on the Website; however, registration entitles the Customer to a 10% discount applicable from the first purchase of the Products.
4.2 The registration process requires completing an electronic form, the fields of which must be filled in with the Customer's personal data and email address. Such data will be processed in accordance with current privacy regulations (EU Reg. 679/2016).
4.3 From the personal account dashboard, the Customer can: view recent orders; manage shipping and billing addresses; change the password and account details.
5. Purchase methods
5.1 The essential characteristics and prices of the Products are stated in the offer relating to each individual Product available on the Website.
5.2 To purchase the Products, the Customer must complete and submit the purchase order form to Manetti Blanchard S.r.l. in electronic format, following the instructions on the Website. The Customer must place the product in the appropriate “cart” and, after reviewing and accepting the shipping costs, as well as the General Terms, the Privacy Policy, and the terms regarding the right of withdrawal, must select the desired payment method and click “submit order”.
6. Conclusion of the contract
6.1 The Contract concluded between Manetti Blanchard S.r.l. and the Customer shall be deemed concluded when Manetti Blanchard S.r.l. sends the Customer, who has submitted the order, a confirmation of receipt.
6.2 The order submitted by the Customer will be binding on Manetti Blanchard S.r.l. only if the entire purchase process has been completed properly, without any error messages from the Website.
6.3 Manetti Blanchard S.r.l. is not liable for malfunctions caused by the data transmission network operator.
6.4 By submitting the order to Manetti Blanchard S.r.l., the Customer acknowledges and declares that they have reviewed all the information provided during the purchase process and fully accept the General Terms.
6.5 The purchase order form will be stored in the Website's database for the period necessary to fulfill the order.
6.6 Manetti Blanchard S.r.l. will send the Customer an email confirming receipt of the purchase order submitted by the Customer, containing the essential characteristics of the purchased Products, the date and time the order was placed, the Manetti Blanchard S.r.l. address, information on customer service and existing commercial warranties, the terms of withdrawal, a detailed indication of the price, the payment method selected by the Customer, and the delivery costs.
6.7 The Customer must promptly check the contents of the communication and immediately report any errors or omissions to Manetti Blanchard S.r.l.
7. Payment methods
7.1 The Customer may pay the price of the Products and the related shipping costs using the following methods: credit card, as specified below.
Credit card:
Payments are accepted via PayPal using VISA, VISA ELECTRON, MASTERCARD, and MAESTRO credit cards. To pay by credit card without having a PayPal account, select the Credit Card with PayPal payment method during order confirmation and then, when the Customer is redirected to the payment page on the PayPal website, click the “Continue” link.
8. Shipping
8.1 Shipping costs are borne by the Customer (except as provided for in Article 2.2 above) and are clearly stated in the order form. These costs may vary depending on the selected shipping method and the destination of the Products.
8.2 All purchases will be delivered by courier on the next business day after the order conclusion date.
8.3 Orders will be fulfilled and delivered from Monday to Friday, excluding holidays and national holidays.
8.4 Manetti Blanchard S.r.l. is not responsible for unforeseeable delays; however, except in cases of force majeure, the Products will be delivered within a maximum period of 30 (thirty) days from the day after the Customer submitted the order to Manetti Blanchard S.r.l..
8.5 Upon delivery of the goods by the courier, the Customer is required to check: (i) that the number of packages being delivered matches the number indicated on the transport document (DDT); (ii) that the packaging is intact, undamaged, neither wet nor otherwise altered, including the sealing materials.
8.6 Any damage to the packaging and/or Product, or any discrepancy in the number of packages or other information, must be immediately contested by making a written reservation of inspection on the courier's proof of delivery.
8.7 Once the courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of the delivered items.
8.8 If Manetti Blanchard S.r.l. is unable to deliver the ordered goods due to the subsequent unavailability, even temporary, of the Products, it will promptly inform the Customer by email, and in any case no later than 30 (thirty) days. The amount already paid by the Customer will be refunded as soon as possible, and in any case no later than 30 (thirty) days from receipt of the purchase order.
8.9 Manetti Blanchard S.r.l. will send the Customer a confirmation email once the Products have been shipped. To ensure the safe delivery of the Product, Manetti Blanchard S.r.l. will retain the tracking number for each delivery made.
9. Right of withdrawal
9.1 The Customer always has the right to withdraw from the concluded contract without paying any penalty and without stating a reason, within 14 (fourteen) days from the date of receipt of the purchased item, using the downloadable form from the link or by providing written notice in a free-form and explicit manner.
9.2 If the Customer decides to exercise the right of withdrawal, they must send the notice to Manetti Blanchard S.r.l. by registered mail with return receipt to Via M. Gonzaga 7, 20123 Milan, and send an advance copy by email to info@manettiblanchard.it; the post office stamp on the issued receipt will serve as proof.
9.3 The Customer must return the Product no later than 14 (fourteen) days from the date of the withdrawal notice, or forfeit the right of withdrawal.
9.4 To be entitled to a full refund of the price paid, the Product must be returned intact, in its original packaging, and must not have been opened or used by the Customer.
9.5 For the purposes of exercising the right of withdrawal pursuant to this Article, the Customer is responsible for the costs of returning the Product to Manetti Blanchard S.r.l..
9.6 Manetti Blanchard S.r.l. will refund the price paid by the Customer after receiving the Product subject to the withdrawal in the manner indicated in the preceding points.
10. Warranty
10.1 Manetti Blanchard S.r.l. guarantees that the Products are made with the best raw materials and comply with the currently applicable regulations for cosmetic products.
10.2 The Customer is fully responsible for the purchase made on the Website and undertakes to carefully read the instructions and warnings for use of the purchased Products and to use them in compliance with such conditions.
10.3 Manetti Blanchard S.r.l. shall not be liable for any use of the Products that does not comply with the instructions for use and/or is generally inconsistent with their intended purpose.
11. Amendments to the general terms and conditions
11.1 Manetti Blanchard S.r.l. reserves the right to amend these General Terms at any time.
11.2 Any changes, amendments, deletions, or additions will take effect immediately upon communication through notices published on the Website.
11.3 Once such communication has been made, any access to and use of the services of Manetti Blanchard S.r.l. by the Customer shall be deemed full acceptance of the changes.
12. Service suspensions
12.1 Manetti Blanchard S.r.l. reserves the right to temporarily suspend, without prior notice, the provision of the Product sales service for the time strictly necessary to carry out technical interventions required and/or appropriate to improve its quality.
12.2 Manetti Blanchard S.r.l. may, at any time, discontinue the provision of the Product sales service if there are justified security reasons or confidentiality breaches, in which case it will inform the Customer.
13. Communications and complaints
13.1 The Customer may contact Manetti Blanchard S.r.l. for any communication and/or complaint by completing the form on the Website in the “contacts” menu or by sending an email to: info@manettiblanchard.it.
13.2 Communications and/or complaints received by Manetti Blanchard S.r.l. in a manner other than that indicated in Article 13.1 above will not be considered.
14. Applicable law and Jurisdiction
14.1 These General Terms are governed by Italian law.
14.2 Any dispute concerning the interpretation and performance of these General Terms shall be subject to the exclusive jurisdiction of the court of the consumer's place of residence or domicile, pursuant to Article 66-bis of Legislative Decree 206/2005.
